N.B. REGIONAL COUNCIL OF CARPENTERS, MILLWRIGHTS & ALLIED WORKERS
HIRING PROCEDURES & TRADE RULES
GENERAL
1. All members are required to know the Constitution, By-laws and Trade Rules of their Local. Ignorance of these laws shall excuse no one from the imposition of appropriate penalty in cases of breach.
2. Only members in good standing of Locals 1386 or 2262 are eligible for dispatch or referral by their Local.
UNEMPLOYED LIST
3. Locals 1386 and 2262 of the Regional Council shall keep a detailed and up-to-date list of their respective unemployed members; said lists to be typed and posted on board in plain view of all members or presented at the monthly and/or regular membership meetings.
4. Members whose names appear on the unemployed list must be available for work. Members have sole responsibility to keep the union office aware of any change of address or telephone number.
5. Any mistake made on the unemployment lists may and shall be corrected at the regular monthly meeting or otherwise, at the discretion of the business representative.
6. A members name will go on the unemployed list the day the member or the union-designated official personally notifies the Council or Local of the lay-off(s).
7. Where more than one member is laid-off from one employer within a 24-hour period, the Business Manager will determine the order on which the affected members names will appear on the unemployed list by draw.
8. When a member is dispatched to work, his name will be removed from the unemployed list, unless the job lasts no more than one (1) day, in which case, his name will remain on top. In such a situation, if another request is made for a one (1) day job, the member next following on the list will be dispatched.
9. Refusal of a work referral by a member will result in that members name being dropped to the bottom of the unemployed list unless the members refusal is justified as per a physicians (Doctor) note or where the member must attend the funeral of an immediate family member.
10. A member who fails to report on a job to which he was dispatched will see his name dropped to the bottom of the unemployed list.
DISPATCH
11. Members will be dispatched only by the union office.
12. The union office shall begin dispatch from the top of the unemployed list.
13. If a member cannot be contacted within one (1) hour from the initial call, the union office will call the next member, and so on.
14. Name requests are not allowed until a member has been in the Local Union for a minimum of ninety (90) days, unless the unemployed list is empty.
15. Notwithstanding any provision of these procedure and rules, members agreeing to work as salts can, at the sole discretion of the EST and/or Business Representatives, be given priority for any dispatch or moved up on the unemployed list.
16. In keeping with the spirit of the International Constitution, no member who operates a construction business not signatory to the Councils collective agreements is available for dispatch through the union and the name of any such individual member may, at the sole discretion of the EST, be removed from the unemployed list.
17. If a member is called after hours to work by a contractor the member must report this to the dispatcher by the next day.
18. When dispatching members to a site the dispatcher has the authorization to skip members on that out of work list so he/she may call the qualified /skilled members the contractor needs for that particular job.
WORKING IN ANOTHER JURISDICTION
19. If a member is called by the hiring hall for dispatch and refuses a job because he or she is employed other than under one of the UBCJA collective agreements, that members name shall be dropped to the bottom of the unemployed list. If the member refuses a second dispatch, the members name will be removed from the list until that member notifies the Union that he or she is available for work.
20. A member who desires to work in another jurisdiction and who does not wish to transfer membership shall, before going to work in another jurisdiction, secure a dispatch from the other union and report the same to his home local including current contact numbers.
21. Members who obtain work in another jurisdiction shall maintain their position on the out-of-work list by being put on hold for a period of three months (90 days). If the member does not return within that period, his/her name will be removed from the out of work list. The member must then call 1-888-247-5177 to report a lay-off and to be placed on the bottom of the out-of-work list.
22. Members who refuse a dispatch to another jurisdiction will not be penalized.
JOB STEWARD
23. It shall be the responsibility of the job steward to check dues books of all members on site. Foremen shall refer members newly hired to the steward for this purpose.
24. The steward shall see to it that members start and stop work at the hours agreed upon.
25. The steward shall ensure that the contractor provides proper facilities for toilets and drinking water, as well as the necessary protective clothing and safety equipment. He shall also see to it that proper storage space is provided for tools, including storage at mealtimes.
26. In case of accident or sudden illness of a member, the steward shall ensure that the tools of the member are properly collected, tagged and locked.
OTHER
27. No Union member shall be permitted to furnish any power tool whatsoever. Union members shall have the care and control and shall operate power tools supplied by the employer.
28. Any member of the Council knowingly working on a union job with non-union employees must, within 48 hours of acquiring knowledge of this, notify a union representative of the situation.
29. Any member holding office with any Local Union within the Regional Council ,or that is a delegate of the Regional Council shall be immediately removed from office or as a delegate if they are found to be working non-union and not reporting same to the union unless they are aiding with organizing efforts.
30. When a ratification vote is held only members in goodstanding are eligible to vote, regardless of length of membership.
